Job Responsibilities
Under limited supervision, serves as a senior attorney to provide legal advice and counsel to boards and program areas within LLR, during administrative hearings, board meetings, and other agency matters, including representing the agency during appeals arising from application denials. Represents the boards at the administrative law court, circuit court, court of appeals, supreme court, and federal court. Completes special projects or other work as assigned by General Counsel or Agency Director.
Provides legal advice to the Professional and Occupational Licensing (POL) Boards and program directors. Assists program directors and board chairs in developing meeting agendas. Advises boards during hearings and board meetings on legal and evidentiary matters including, but not limited to, conducting legal research, preparing orders, and/or drafting advisory opinions. Has a thorough and comprehensive knowledge of the APA, FOIA, Title 40, Rules of Evidence, and the various professions and occupations. Represents boards in appeals and in state or federal court, as required.
Serves as a senior attorney to identify issues and understand and interpret current, pending, and newly enacted laws and regulations in order to provide recommendations for resolution. Assists with drafting regulations and implementing legislation. Researches and stays abreast of relevant legal issues that affect licensing, administrative law, and the administrative hearing process. Assists the agency and boards/program areas with analyzing proposed legislation, rules, regulations, and procedures. Assists in research, analysis, and preparation of consistent policies and procedures among boards and staff. Represents the agency and/or board/program areas in meetings or special task force/committees. May testify at legislative hearings on behalf of the agency or board/program areas.
Provides assistance and training to board members regarding administrative procedures for conducting hearings and rules of order. Provides general advice to agency personnel, including board administrators, the Agency Director, and Deputy Directors regarding the administration of the boards. Trains newly hired attorneys and staff.
Assists General Counsel to streamline case processing and works with strategic planning efforts in support of LLR’s mission and directives. Completes other duties and special projects as assigned.
Minimum and Additional Requirements
State Minimum Requirements: A Juris Doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
Knowledge of SC laws, Administrative Procedures Act, policies, standards and procedures of the AG’s office, general case, statutory and common law, judicial and quasi-judicial procedures and rules of guidance, knowledge of Agency structure, mission, programs, and objectives. Ability to interpret laws, analyze facts, evidence, and legal instruments, express conclusions and arguments clearly and logically, make presentations, and prepare reports. Ability to apply and explain laws and regulations of boards. Legal research and drafting of briefs, orders, and legal memoranda.
Under limited supervision of the General Counsel, serves as a senior attorney and will have a broad range of independence and discretion. Must be self-motivated.
Occasional overnight travel and weekend assignments. The position is located in an office environment with long periods of sitting. May require occasional work outside of normal office hours.
Preferred Qualifications
Preferred Requirements: A Juris Doctor or its equivalent from an accredited law school and ten (10) years experience as a practicing attorney. Member of the SC Bar and completion of the Rule 403 requirements.
