Associate Counsel, Trademarks

Description
• Perform global trademark clearance: review preliminary searches, analyze full search reports and draft availability opinions.
• Advise clients, including senior leadership, on trademark, trade dress, copyright and related brand protection matters.
• Oversee the trademark portfolios for multiple brands including strategizing on trademark filings, responding to office actions, managing renewals, collaborating with foreign counsel.
• Manage complex global trademark disputes including reviewing watch notices, preparing cease and desist letters, reviewing opposition documents, negotiating settlements, drafting settlement and coexistence agreements, and managing outside counsel handling conflict and litigation matters.
• Support M&A activity including trademark due diligence analysis and post-closing integration of newly acquired trademark portfolios.
• Develop and deliver training and educational materials on company policies and procedures and proper trademark use.
• Draft license agreements, assignments, and other trademark-related transactional documents.
• Manage domain name portfolios and domain name disputes.

Qualifications:
• J.D. and a minimum of 8 years’ experience with trademark law, including extensive experience with trademark searches, trademark enforcement, managing trademark portfolios and counseling clients.
• Licensed or eligible to practice in NY.
• A combination of top-tier law firm and in-house experience is preferred, as well as experience in the cosmetics or consumer products industry.
• Must have executive presence and ability to form strong relationships with business leaders.
• Ability to work independently and execute in a complex matrixed environment.

The anticipated base salary range for this position is $149,500 to $257,000. Exact salary depends on several factors such as experience, skills, education, and budget. Salary range may vary based on geographic location. In addition to base salary, this position is eligible for participation in a highly competitive bonus program with possibility for overachievement based on performance and company results as well as participation in the share incentive plan.
