Associate Counsel – Albany – The Industrial Board of Appeals

MINIMUM QUALIFICATIONS:

Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and four years of relevant post-bar experience.

PREFERRED QUALIFICATION:

Ability to initiate and maintain relationships across a diverse set of stakeholders

Duties Description The Industrial Board of Appeals is an independent state agency which provides parties the opportunity to be heard regarding rules, regulations, determinations and orders issued by the Department of Labor.

STANDARD DUTIES: The Associate Counsel presents cases to the Board at Board meetings, presides in proceedings as a hearing officer, and drafts, reviews and edits decisions. The Associate Counsel also stays current and advises as needed on developments in federal and state court cases. The Associate Counsel will:

Draft and edit Board decisions
• Timely draft decisions, as assigned, for the Board’s consideration that reflect logical and legal reasoning written in a clear and well-organized fashion.
• Appropriately cite statutes, regulations, case law and other legal authority in drafting or editing of decisions.
• Review and edit decisions drafted by other staff, as assigned.
• Prepare summary of Board decisions to be posted on Board website, as assigned.

Conduct pre-hearing and case management conferences
• Provide fair and impartial conferences in anticipation of hearing.
• Conduct informed discussion of case during conference.
• Explain Industrial Board of Appeals procedure to the parties.
• Accurately answer questions relating to the IBA procedure.

Conduct Hearings
• Serve as fair and impartial hearing officer while hearing evidence and ruling on objections, admission of evidence, and motions.
• Display appropriate judicial temperament.
• Ensure clarity of record and orderliness of proceedings.
• Exercise appropriate discretion.

Provide legal advice
• Research general issues of substantive or procedural law for the Industrial Board of Appeals in a thorough, accurate and timely manner.
• Provide information and guidance on researched issues.
• Provide well-reasoned written legal guidance to the Chairperson or Board members as requested.

Assist in other functions as necessary possibly including but not limited to administrative tasks, case management tasks, development or revision of office policies, procedures, and best practices.
