Non-Competitive Promotion Qualifications:
If the number of direct line candidates is three or less, a competitive examination will not be held and the agency, at its discretion, may nominate a candidate for a non-competitive promotion under the provision of Section 52.7 of the Civil Service Law. If approved by Civil Service, this would be considered a permanent appointment. In order to be eligible for a NCP, candidates must be an employee of the Workers’ Compensation Board (WCB) and have one year of permanent competitive service as a Legal Assistant 1 (SG-14).
Provisional Qualifications:
Promotion: one year of service as a Legal Assistant 1.
Open Competitive: a Bachelor’s Degree in a paralegal or legal assistant program from a regionally accredited college or university or one approved by ABA OR an Associate’s Degree in a paralegal or legal assistant program from a regionally accredited college or university or one approved by the ABA OR a certificate in a paralegal or legal assistant program from a regionally accredited college or university or one approved by the ABA AND one year of experience as a paralegal or legal assistant.
If appointed provisionally, the incumbent will need to take the next Civil Service examination for this title and pass with a score that will be immediately reachable on the resulting eligible list. Failure to take, pass and achieve a reachable score on the examination may result in revocation of the appointment.
Duties Description Under the direction of the Workers’ Compensation Program Manager 2 and Senior Attorneys, the Legal Assistant 2 will provide support for the Penalty Collections Unit. Duties include, but are not limited to, the following:
• Assist Senior Attorneys with assigned matters, including drafting correspondence and related documents.
• Perform routine investigative work and initial research to locate debtor location and assets and make recommendations to Senior Attorneys
• Draft information subpoenas, wage garnishments, pleadings, discovery demands/responses, routine motions and other documents related to the enforcement of judgments. File documents with appropriate courts and schedule court appearances as necessary.
• Track status of assigned judgments and associated deadlines via Microsoft Excel
• Draft settlement documents and payment plans for judgment enforcement matters
• Perform monthly searches for unclaimed funds with the Office of the State Comptroller
• Prepare monthly report of collections activities
