Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $60,000 – $65,000 Annually
Position Summary: This position is in the Medicaid Fraud Unit. The Attorney General’s Medicaid Fraud Control Unit (MFCU) investigates and prosecutes fraud involving providers that intentionally defraud the state’s Medicaid program through fraudulent billing practices. The MFCU investigates allegations of patient abuse, neglect, and exploitation in facilities receiving payments under the Medicaid program, such as nursing homes, facilities for the mentally and physically disabled, and assisted living facilities. The MFCU investigates a wide range of misconduct originating primarily from fraudulent billing schemes. The most common schemes involve doctors, dentists, clinics, and other healthcare providers billing for services never performed, overbilling for services provided, or billing for tests, services, and products that are medically unnecessary.
Qualifications: Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
The required legal experience must be from the practice of law in a state or territory of the United States.
The Work You Will Do: The incumbent will be responsible for, but not limited to the following:
- Represent the State of Florida in all Medicaid Fraud Cases, handle settlement negotiations, pleadings, depositions, pre-trial, jury, and non-jury trials, and post-trial and appellate practice related to MFCU cases.
- Research and draft motions, discovery responses, memoranda, briefs, opinions, orders, settlements, subpoenas, and other miscellaneous pleadings and documents.
- Provide guidance and leadership to entry-level attorneys.
- Coordinate the investigation and litigation of MFCU cases.
- Exercise a thorough working knowledge of federal and state rules of procedure, evidence, and substantive law.
- Provide MFCU investigators, analysts, and auditors with legal advice and assistance related to MFCU investigations.
- Provide legal assistance to the Director with regard to MFCU matters.
- Perform routine administrative matters, including attending staff meetings, providing case status reports, documenting case files, preparing travel vouchers, tracking time records, and filing documents, etc.
- Respond to public records requests.
- Requires the ability to research and work independently and may involve travel in and out of state.
- Reviews MFCU Standard Operating Procedures for statutory corrections.
- Works with Digital Evidence Recovery and Examination Unit in drafting digital search warrants and affidavits for MFCU.
- Maintain current expertise in areas of practice, including reading recent judicial decisions and case summaries and attending continuing legal education and other professional seminars.
- Other duties as assigned.
